Smart Electronics Affiliates Program Terms and Conditions
Hello! and welcome to our Smart Electronics Affiliate Program. We are here to help. Please do not hesitate to contact us if you have any questions.
Program Participation
Enrollment in the Smart Electronics Affiliates Program begins with our acceptance of your completed Affiliates Program Application. We reserve the right to reject any application if we determine (at our sole discretion) that the site submitted is unsuitable
for participation in our program. Sites may be deemed unsuitable for the following reasons.
Site promotes violence, racism, or illegal activity.
Site violates our, or someone else's, intellectual property rights.
Site promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
Affiliates may promote our store and products in any reasonable fashion. We have no objections to adult webmasters that wish to earn a commission by promoting our store on their adult orientated sites.
We have no objections at this time towards the use of consoles, whether they be exit, blur, entrance or other. Use of email promotion is acceptable as long as the Affiliate obeys the current SPAM legislation.
Affiliate's Sales Area
Smart Electronics will makes available to it's Affiliates an area of the site where Affiliates may check their account balances and view the number of orders received through their Affiliate links to our smart electronics website. At no time will Affiliates be
allowed to view actual customer information.
Available Electronics Products
Smart Electronics will make available to it's Affiliates various electronics and related products that we sell. Smart Electronics may elect to add other products to this list from time to time. These products may, or may not, be eligible for paid
commissions. Affiliates will be notified when products are added and may elect to participate or withdraw from the program.
Graphic Requirements
In order to properly credit any sales initiated from your site, you will place the links according to our specifications and include your assigned user ID. This link may originate from any page within your site, however, the more prominent the link, or links,
the greater your sales potential. This product sales link will be directed to an area of our site where our products will be available to the customer. Smart Electronics will not be liable for payment of any commission where there is a failure by you to
prepare the links according to our specifications, or where we are unable to properly identify the originating site.
Processing of Orders
All orders placed by customers will be processed by Smart Electronics and shall be shipped by us.
Commission Fees
Affiliate Program members shall receive a 4% commission on any item sold as a result of the customer being directed to our site by the Affiliate provided a sale occurs at that time. Subsequent visits by the customer shall be paid and tracked for 30 days.
Payment shall be made every two weeks.
If customer returns the item or the transaction by the customer was fradulent any commission paid may be deducted from future payments.
Liability Disclaimer
Smart Electronics assumes no liability for any loss of revenue, nor indirect or consequential damages arising in connection with this Agreement or participation in Affiliates Program. We make no warranties beyond those provided, either express or implied,
concerning the products or services provided by Smart Electronics. We will not be held liable for any errors or service interruptions regardless of cause. Further, the operation and/or maintenance of the Affiliate site shall be solely the responsibility of the
Affiliate.
Limited License
Smart Electronics grants to it's Affiliates Program members a limited license to use only those images, graphics, and/or text provided by Smart Electronics for use in this program. Affiliate may use such material only as indicated by Smart Electronics in the
promotion of this program and may not alter or modify it in any way without the express permission of Smart Electronics. Smart Electronics reserves the rights to said material, including trademarks and any and all intellectual property rights.
Terms of Agreement
The term of this agreement shall begin upon our acceptance of the completed Affiliates Programs Application and shall continue in full force and effect as long as the Affiliate is a participant in the program, or until terminated at any time by either party
with 30 day written notice. However, regardless of any notice of termination, the Affiliate shall be held liable to the terms contained herein as long as Affiliate continues to display program material on their site. Smart Electronics may terminate this
agreement if it finds that the Affiliate is no longer in compliance with this agreement. Upon termination of this Agreement no further commissions shall be paid, except that any commissions previously accrued under the Agreement, but not yet paid, shall be
paid according to schedule.
Relationship of Parties
Affiliate Program members are considered to be independent contractors and as such cannot make any representations, written or otherwise, for or in behalf of Smart Electronics. Smart Electronics shall not be held liable for any such representations.
